What Are The Steps In Your Ch. 13 Bankruptcy in the Kansas City Area?
We will gather all of your financial information and prepare the document to file with the Bankruptcy court in Missouri or Kansas.
We will prepare your Bankruptcy court filing document (called a “Petition”), which will include the following items:
Schedules of your assets and debts
A schedule of your current income and expenses
A statement of your financial affairs
A schedule of your executory contracts and unexpired leases, if applicable
We will gather and give the Kansas or Missouri Bankruptcy court additional documents:
A Chapter 13 Bankruptcy Plan (a debt re-payment plan) that must be approved by the Bankruptcy
A copy of the last two years of your filed federal and Missouri or Kansas tax returns
A copy of your federal and Missouri or Kansas tax returns filed during the your Bankruptcy case in Kansas or Missouri
A certificate of credit counseling
A copy of your pay stubs or bank statements to prove your income received in the 60 days before your Chapter 13 Bankruptcy filing
A statement of your monthly net income and any anticipated increase in your income or expenses after your Chapter 13 Bankruptcy filing
A record of any interest you have in federal, Missouri or Kansas qualified education or tuition accounts.
What happens after all my documents are filed with the Kansas City area Bankruptcy court?
There will be a meeting of your creditors after your documents are filed with the Missouri or Kansas Bankruptcy court.
Creditors must file their “Proof of Claim” with the Chapter 13 Bankruptcy court.
You must begin making your regular payments to the Bankruptcy Trustee even before the court approves your re-payment plan in Kansas or Missouri.
Your re-payment plan must be approved by the Missouri or Kansas Chapter 13 Bankruptcy court.
After your re-payment plan is approved by the Chapter 13 Bankruptcy court, you will make your payments to the Trustee on a regular basis, usually bi-weekly or monthly.
Your debts will be wiped out or eliminated after you make all your Bankruptcy Plan payments, except for a few types of debts like home first home mortgage, alimony, child support, taxes, etc.
